Terms of Service

Brinmart is a classifieds platform that connects buyers and sellers in Nigeria. We operate under Brinmart Technologies and can be reached at support@brinmart.com.

We are not a marketplace in the legal sense of being party to your transactions. We don't hold your money, we don't ship items, and we don't guarantee anything sold on the platform. We connect buyers and sellers and provide tools to make those connections easier and safer.

You must be at least 18 years old and capable of forming a binding contract to use Brinmart. By signing up you confirm both.

If you're using Brinmart on behalf of a business, you confirm you have authority to bind that business.

You are responsible for everything that happens on your account, including keeping your password secure. If you suspect unauthorised access, change your password immediately and email us.

Provide accurate information when you sign up. We may suspend accounts that use fake names, fake photos, or other people's identity documents.

You may post listings for items or services you legally own or are authorised to sell.

You may not post:

• Stolen goods, counterfeit items, or anything you don't have the right to sell
• Weapons, ammunition, illegal drugs, or controlled substances
• Adult content, escort services, or anything sexual in nature
• Multi-level marketing schemes, financial pyramids, or get-rich-quick offers
• Items that infringe copyright, trademark, or other intellectual property
• Live animals (unless permitted by Nigerian law and properly disclosed)
• Anything misleading: fake photos, false specifications, hidden defects

We may remove any listing at our discretion. Repeat violations result in account termination.

Brinmart does not process payments for sales between buyers and sellers. Any money exchanged is between the two of you, off-platform.

You agree that:

• We are not party to your transactions
• We do not guarantee the quality, safety, or legality of any item
• We do not verify ownership of items being sold
• Disputes about money, item condition, or delivery are between you and the other party

We strongly recommend you follow our safety tips — meet in public, inspect items, and never send money in advance.

The platform itself is free to use for listing and contacting sellers. We charge for optional services:

• Boost: ₦1,500–₦75,000 to feature your listing across the marketplace. Non-refundable once activated.
• Verification badge: ₦2,000 one-time. Non-refundable, even if your application is rejected. This fee acts as an anti-spam barrier.
• Top-up fee: 1% on wallet top-ups, covering payment processing.

Withdrawals to your bank are free and arrive instantly via Paystack.

Verified sellers are users who have submitted government ID and a selfie, and whose application has been approved by our team.

Verification is a trust signal, not a guarantee. We make reasonable efforts to confirm identity but cannot prevent all fraud. Always follow safety practices regardless of whether a seller is verified.

You agree that your submitted ID and selfie will be stored securely, used only for verification, and never shared publicly or with third parties (except where legally required).

You may not:

• Use Brinmart for any illegal purpose
• Spam, harass, threaten, or abuse other users
• Attempt to defraud buyers or sellers
• Scrape, crawl, or mass-download data from the platform
• Attempt to access accounts that aren't yours
• Reverse-engineer, decompile, or otherwise attempt to extract source code
• Create multiple accounts to evade restrictions

Violations may result in immediate account suspension or termination, and we may forward evidence to law enforcement.

You retain ownership of the photos and descriptions you upload. By posting them, you grant Brinmart a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the platform.

You confirm you have the right to post anything you upload — including the right to use any photos.

We may suspend or terminate your account at any time, with or without notice, if we believe you've violated these Terms or pose a risk to other users.

You may close your account at any time by emailing support@brinmart.com. Any wallet balance can be withdrawn before closure.

Brinmart is provided "as is" and "as available". We make no warranties — express or implied — about:

• The accuracy or reliability of any listing
• The identity, character, or intentions of other users
• The quality, safety, or legality of any item or service
• The platform being uninterrupted, error-free, or secure

To the maximum extent permitted by Nigerian law, Brinmart and its team are not liable for any indirect, incidental, or consequential damages arising from your use of the platform — including but not limited to lost money in transactions, lost data, or harm caused by other users.

Our total liability to you, for any claim, is limited to the amount you've paid Brinmart in fees in the 12 months preceding the claim, or ₦10,000, whichever is greater.

You agree to indemnify and hold Brinmart harmless from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your listings, or your interactions with other users.

We may update these Terms from time to time. If we make material changes, we'll notify you by email or via an in-app notification. Continued use of Brinmart after changes take effect means you accept the new Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be resolved in the courts of Lagos State.
